Terms & Conditions

These terms govern your use of this website and set out the basis on which M & K Estates and Consultancy provides information and accepts enquiries. Separate written terms apply to each sales, lettings, management, guaranteed rent or remodelling instruction.

1. About these terms

This website is operated by M & K Estates and Consultancy ("M & K", "we", "us") of 303 Purley Way, Croydon, CR0 4NU. By using the website you agree to these terms and to our Privacy Policy. If you do not agree, please do not use the website.

2. Use of the website

  • You may browse the website and submit enquiries for your own personal or business use.
  • You must not attempt to gain unauthorised access to the website, submit automated or bulk enquiries, or use the website to send unlawful, misleading or offensive content.
  • We may suspend or withdraw the website, or any part of it, at any time without notice.
  • Links to third-party websites (including property portals, redress schemes and review platforms) are provided for convenience. We are not responsible for their content.

3. Property information

Property particulars on this website are prepared in good faith from information supplied by the seller or landlord and from our own inspection. They are a general guide only and do not form part of any offer or contract. Measurements, floor plans, photographs, council tax bands, EPC ratings and availability may change and should be verified by your solicitor, surveyor or by inspection before you rely on them. Prices and rents are as advertised at the time of publication and may be subject to negotiation.

4. Valuations & enquiries

  • Valuations requested through this website are free of charge and without obligation. They are marketing appraisals — an opinion of the price or rent a property is likely to achieve — and are not formal RICS valuations for lending, tax or legal purposes.
  • By submitting a valuation request or enquiry you confirm that the information you provide is accurate and that you are entitled to provide it.
  • We aim to respond to enquiries within one working day but do not guarantee response times.
  • Website forms are transmitted through a third-party form-processing service and delivered to our email inbox. Please do not include sensitive financial information such as card or bank details in a form.

5. Fees & agency terms

Our sales and lettings commission starts at 1%. The fee for any instruction — including full management, guaranteed rent and remodelling — is confirmed in a written agreement before work begins, together with the term, notice period and what is included. Where we act as your agent we do so under the Estate Agents Act 1979, the Consumer Protection from Unfair Trading Regulations 2008 and, for lettings, the Tenant Fees Act 2019 and applicable client money protection requirements. Guaranteed rent agreements are lease agreements between you and M & K and are governed by their own written terms.

6. Tenant information

We do not charge tenants any fees other than the payments permitted by the Tenant Fees Act 2019: rent, a refundable holding deposit capped at one week's rent, a refundable tenancy deposit capped at five weeks' rent (for annual rents under £50,000), and default charges permitted by the Act. A holding deposit may be retained if you withdraw, fail a Right to Rent check or provide false or misleading information. Tenancy deposits are protected with a government-approved scheme within 30 days.

7. Complaints & redress

We are a member of a government-approved property redress scheme. If you have a complaint, please raise it with Mr. Kay Oki in writing at info@mkestatesandconsultancy.co.uk. We will acknowledge it within three working days and provide a final response within 15 working days. If you remain dissatisfied you may refer the matter to our redress scheme, details of which are available on request and displayed in our office.

8. Intellectual property

The M & K Estates and Consultancy name, roofline logo, website design, text and photography are owned by or licensed to us. You may view and print pages for personal reference but may not reproduce, distribute or use any content for commercial purposes without our written permission. Property photographs and particulars remain our copyright and may not be reused by other agents.

9. Liability

We take reasonable care to keep the website accurate and available but do not warrant that it will be error-free, uninterrupted or free from viruses. To the extent permitted by law we exclude liability for any loss arising from reliance on website content or from inability to access the website. Nothing in these terms limits our liability for death or personal injury caused by negligence, fraud, or any other liability that cannot be excluded by law. Our liability under any instruction is set out in the relevant written agreement.

10. Governing law

These terms are governed by the laws of England and Wales, and the courts of England and Wales have exclusive jurisdiction over any dispute arising from them. If any provision is found to be unenforceable, the remaining provisions continue in full effect. We may revise these terms at any time by updating this page.
